Visa for “family reasons”

Following the recent amendment of art. 23 of Legislative Decree 30/2007, starting from 1 June 2024, foreign family members of Italian/EU citizens who will travel to Italy for the purpose of family reunification, will have to apply for a national visa for “family reasons”, as provided for by D.I. 850/2011 annex A point 10, although the issuance of Nulla Osta by the competent Single Desk for Immigration (Prefettura) is not required.

Requirements and conditions:

The family members who have the right to family reunification are exclusively those identified in art. 2 of Legislative Decree 30/2007:

(1) your spouse;

(2) a partner who has entered into a registered partnership with the Union citizen on the basis of the law of a Member State, where the legislation of the host Member State treats a registered partnership in the same way as marriage and in compliance with the conditions laid down in the relevant legislation of the host Member State;

(3) direct descendants under the age of 21 or dependents and those of the spouse or partner referred to in point (b); (4) dependent direct relatives in the ascending line and those of the spouse or partner referred to in point (b).

Adoptees/adopters and minors subject to permanent guardianship/foster care with measures issued pursuant to Law 184/83 are also treated as direct descendants/direct ascendants.

Within 8 working days of entering Italy, family members must apply for a residence permit for “family reasons” by filling out the appropriate kit at the Post Offices.

Documentation:

– Letter of invitation from the Italian/EU family member stating the intention to exercise the right to family unity accompanied by a valid identity document.

– Civil status documentation certifying the condition of family member pursuant to art. 2 of Legislative Decree 30/2007 translated and legalized, or marriage or civil union certificate transcribed in Italy.

– In cases where cargo assessment is required, appropriate supporting documentation

Family members (art. 2 of Legislative Decree 30/2007) who accompany or join the Italian/EU citizen for periods of less than 3 months, will continue to be issued a visa for tourism/family visits.

Other family members (art.3 of Legislative Decree 30/2007) who accompany or join the Italian/EU citizen for periods of less than 3 months will be issued an ordinary visa for tourism/family visits.
